The law in Tasmania requires all property purchases to be evidenced in writing. Usually the Agent will prepare the Contract for Sale for you. However, once the contract is signed, you have very few rights against the Vendor unless it is written in the Contract. We strongly recommend that you do not sign any contract that you are not sure about. Let us help you by reviewing and advising you before you sign.

Including conditions precedent in a Contract for Sale allows you to make sure certain events occur before you are bound by the terms of the Contract. These usually include use of the property, finance, sale of an existing property, building inspection, compliance with Council requirements, and boundary survey, but can include anything you need. Our lawyers are trained to advise you about these legal issues and draft the necessary clauses for you, so that your legal position is fully protected.

If you are purchasing a property to be owned by two or more people it is important to get the form of ownership correct to what best suit your needs. In Tasmania, real estate can be owned jointly in two ways – either Joint Tenants or Tenants In Common. Our lawyers are trained to advise you about the consequences of these forms of ownership, so you can make a fully informed decision. In Tasmania, if the Contract you sign provides that a deposit should be paid by you to the Agent upon signing, it is important that you have the deposit ready to give to the Agent upon signing. If you do not pay the deposit at this time, the Vendor may treat this as a breach of the Contract, and has the option to cancel the Contract. Our lawyers can assist and advise you about this obligation, and other ways and means of paying the deposit, so that your legal position is properly protected.

All purchasers of real estate in Tasmania are subject to the payment of State Government Duty, unless an exemption is available. If this purchase is your first home, you may be entitled to a full or partial reduction of duty payable on the transfer. Our lawyers are trained to advise you about these exemptions and can assist you with an application if you meet the eligibility criteria. If you are purchasing by Auction, there will be a special form of Contract for Sale by Auction. Our lawyers are trained to review and advise you about the special terms that are included in auction conditions. We can even attend the auction if you instruct us to do so, to assist and advise you through the actual auction process, or to act as your auction agent.

Subject to certain criteria, first home buyers in Tasmania are eligible for the First Home Owners Grant of $7,000.00. Our lawyers are trained to advise you about the First Home Owners Grant, and can assist you with an application if you meet the eligibility criteria. Information in relation to the First Home Owners Grant can be found on the State Revenue Office website at www.sro.tas.gov.au.

We strongly recommend that Purchasers obtain independent property inspections if they have the opportunity to do so. It is preferrable to do this even before you sign a Contract, but in any case you should make it a condition precedent of the Contract that you obtain a satisfactory property inspection report. Our lawyers can arrange for this to be done for you and can advise and assist you if any negative results are found.

Every purchaser is entitled to do a pre-settlement inspection of the property that they are purchasing on the day of, or the day before settlement. The purpose of a pre-settlement inspection is to ensure that the property is in the same condition as when you signed the Contract.
